Spruce Street Saloon Visited by Cop for Violation of Sunday Curfew
Arrested in a raid ordered by Dr. David S. Rhone, director of public safety, Daniel McGettigan, 60, was fined $100 in police court today.
McGettigan said he was bartender of a saloon at 783 Spruce street, raided last night, after Dr. Rhone found it open in violation of the "Sunday-closing" order.
Police Judge Pancoast ordered a warrant issued for the arrest of a man named "John McCauley," of Pine street, after McGettigan said McCauley owned the place.
Two other men arrested in the raid, which was made shortly before midnight Sunday night, failed to appear in court and forfeited $10 security each. They gave their names and addresses last night as Jack Sands, 31, of 915 Spring Garden street, and Harry Hertsch, 47, of 5400 North Fairhill street, both of Philadelphia.
Policeman William Kiker said he was on his way to Second District police headquarters at 11:35 a. m. to start work on the midnight to 8 a. m. shift when he met Dr. Rhone at Ninth and Cherry streets.
"Dr. Rhone told me the saloon at 783 Spruce street was open and told me to close it," Kiker related. "I saw 20 persons drinking in the back room. When I went to the telephone in the saloon to call headquarters for a patrol wagon I found the phone out of order. I had to go to Eighth and Walnut streets to telephone and when I returned all had fled except Sands and Hertsch. I found McGettigan in bed upstairs."
McGettigan testified he hadn't felt well yesterday and went to bed at 2 p. m.
Two automobiles found outside the place were impounded by the police. One bore the Pennsylvania license 23U38 and is said by the police to belong to William Walker, 901 North Moss street, Philadelphia. The other, with Pennsylvania license number B717 belongs to McCauley, according to Kiker. Kiker said he saw McCauley jump out of it and run after the raid.
